Itanium processor is a powerful processor from the Intel Corp, recently Intel had announced that the processor will be discontinued and following this Oracle had mentioned that there will not be any further support on the processor. This had made HP to announce the decision from Oracle as 'anti-customer' act and had issued a statement on this. HP had sued Oracle at the in California stat court in June.
Also the litigation had increased with the hire of Mark Hurd, former chief executive of HP who had to leave due to an allegation with a female contractor. In return HP filed a law suit against Hurd for Trade Secret lawsuit. HP and Oracle had arrived at amicable settlement and the suit was discarded.
HP had also concealed the fact that it was hiring Leo Apothekar as the Chief Executive and Ray Lane as its Chairman and Oracle claims that they were concealing the fact during the agreement on lawsuit.
Apotheker and Oracle CEO Larry Ellison have long been rivals from the time Apotheker headed European software maker SAP AG. HP Chairman Ray Lane and Ellison had a troubled relationship from the time Lane was fired from Oracle in 2000, according to the filing. In response, the spokeswoman for HP,Mylene Mangalindan mentioned that the Oracle Corp is making blatant excuses for its legal obligation to the joint customers. Other claims asserted by Oracle against HP include defamation and intentional interference with contractual relations. Oracle seeks rescission of the Hurd agreement, general and punitive damages and other remedies.
